Wade: APUSH Topics to Study for Test Day"},"content":{"rendered":"<p>There are several important court cases you should know for the APUSH exam. One of those is <em>Roe v. Wade<\/em>. Here are some <em>Roe v. Wade<\/em> APUSH facts to help you review for the exam.<\/p>\n<h2>What Is <em>Roe v. Wade?<\/em><\/h2>\n<p>In 1971, \u201cJane Roe\u201d wanted to have an abortion. Unfortunately for her, Texas law said that a woman could not seek an abortion unless the pregnancy was detrimental to her health. She teamed up with a lawyer to fight against this law.<\/p>\n<p>Eventually, the case made its way to the <a href=\"https:\/\/www.supremecourt.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">Supreme Court<\/a>. The Supreme Court Justices ruled 7-2 that the Texas law was unconstitutional based on the Fourteenth Amendment. Thereby, the case legalized abortion. It said that state laws could not restrict abortions in the first trimester.<\/p>\n<h2>Dates<\/h2>\n<p>Argued: December 13, 1971<br \/>\nReargued: October 11, 1972<br \/>\nSupreme Court Decision: January 22, 1973<\/p>\n<h2>Why Is It Important?<\/h2>\n<p><em>Roe v. Wade<\/em> is one of the most recognized court cases of all time. Due to the Supreme Court ruling for <em>Roe v. Wade<\/em>, abortion is legal during the first trimester of a woman\u2019s pregnancy in the United States.<\/p>\n<p>This continues to be a hotly debated issue throughout the country. People debate whether or not abortion should be legal, who has the power to decide if abortion is legal or not, and how late into a pregnancy abortion should be legal.<\/p>\n<h2>People<\/h2>\n<ul>\n<li><strong>\u201cJane Roe\u201d- <\/strong>Although this is the defendant\u2019s name in the case, Norma Leah McCorvey Nelson admitted that she was the person represented in the case. She couldn\u2019t get an abortion according to Texas law, because she was healthy and the baby wasn\u2019t a product of rape. Lawyers found her and asked to represent the case. She ended up having the baby and giving it up for adoption.<\/li>\n<li><strong>Henry Wade- <\/strong>As the District Attorney of Dallas at the time, he was named as the plaintiff in the case. However, he had very little to do with the case. And luckily, it didn\u2019t negatively impact his career.<\/li>\n<li><strong>Sarah R. Weddington- <\/strong>Before serving as Jane Roe\u2019s lawyer, she worked to find a pregnant woman to represent to fight against the abortion laws in Texas.<\/li>\n<li><strong>Jay Floyd-<\/strong> Although he was the first attorney to prosecute the case, it\u2019s said that he wasn\u2019t well-liked by the Supreme Court Justices.<\/li>\n<li><strong>Robert C. Flowers-<\/strong> After Jay Floyd argued the case, Robert C. Flowers took it over to argue it before the Supreme Court Justices.<\/li>\n<li><strong>Supreme Court Justices-<\/strong> <a href=\"https:\/\/www.biography.com\/people\/thurgood-marshall-9400241\" target=\"_blank\" rel=\"noopener noreferrer\">Thurgood Marshall<\/a>, Byron White, <a href=\"https:\/\/www.c-span.org\/video\/?183168-1\/justice-blackmun-roe-v-wade\" target=\"_blank\" rel=\"noopener noreferrer\">Harry Blackmun<\/a>, <a href=\"http:\/\/www.endroe.org\/dissentsrehnquist.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">William Rehnquist<\/a>, Lewis F. Powell, Jr., Potter Stewart, Warren Burger, William O. Douglas, and William J. Connecticut-<\/a><\/em><\/strong> In 1965, the Supreme Court ruled that states can\u2019t prohibit the use of contraception between adults. Because of this case, the Supreme Court Justices determined that the right to privacy made the Texas laws against abortion illegal.<\/li>\n<li><strong>The Fourteenth Amendment-<\/strong> Adopted in 1868, the <a href=\"http:\/\/www.government-and-constitution.org\/amendments\/14th-amendment.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Fourteen Amendment<\/a> to the United States Constitution discusses rights and equal protection for all citizens. It was this amendment that helped determine the outcome for <em>Griswold v. Connecticut<\/em> and <em>Roe v. Wade.<\/em><\/li>\n<\/ul>\n<h2><em>Roe v. Wade <\/em>APUSH Practice Question 1<\/h2>\n<p>In <em>Roe v. Wade<\/em>, the Supreme Court ruled that state laws prohibiting abortion were unconstitutional, because:<br \/>\na.The religious element could not be included due to separation of church and state.<br \/>\nb.Fetuses don\u2019t have the same equal protection for citizens under the Fourteenth Amendment.<br \/>\nc.states did not have the right to make medical-related laws.<br \/>\nd.women have the right to privacy as determined by a previous case involving contraception.<\/p>\n<p>Answer: D. The Supreme Court determined to legalize abortion based on an earlier case: <em>Griswold v. Connecticut<\/em>. In this case, the Supreme Court determined that it\u2019s a violation of one\u2019s right to privacy to create laws that prohibit the use of contraception.<\/p>\n<h2><em>Roe v. Wade<\/em> APUSH Practice Question 2<\/h2>\n<p>Which earlier court case impacted the Supreme Court ruling for <em>Roe v. Wade<\/em>?<br \/>\na. <em>Gideon v. Wainwright <\/em><br \/>\nb. <em>Griswold v. Connecticut<\/em><br \/>\nc. <em><a href=\"https:\/\/magoosh.com\/hs\/ap\/plessy-v-ferguson-apush-topics\/\">Plessy v. Ferguson<\/a><\/em><br \/>\nd. <em>McCullough v. Maryland<\/em><\/p>\n<p>Answer: B. Since the <em>Griswold v. Connecticut<\/em> ruling occurred 8 years prior, it impacted the results in the <em>Roe v. Wade<\/em> case. The Supreme Court Justices who ruled in favor of Roe determined that the case also fell with the right to privacy clause of the Fourteenth Amendment.<\/p>\n<h2><em>Roe v. Wade<\/em> APUSH Practice Question 3<\/h2>\n<p>The <em>Roe v. Wade<\/em> decision:<br \/>\na. was unanimous among the 9 Supreme Court Justices who heard the case.<br \/>\nb. continues to cause heated debate whether abortion should be legal.<br \/>\nc. angered Americans because it violated their Tenth Amendment rights.<br \/>\nd. only impacted states that didn\u2019t have laws regarding abortion already.<\/p>\n<p>Answer: B. When the ruling in <em>Roe v. Wade<\/em> legalized abortion, many Americans were outraged. Many disagreed with the morality of abortion. Others didn\u2019t think that the Supreme Court should have the power to do this. Abortion continues to be heavily debated year after year.<\/p>\n<h2><em>Roe v. Wade<\/em> APUSH Practice Question 4<\/h2>\n<p>Which Constitutional Amendment influenced the Supreme Court ruling in <em>Roe v. Wade<\/em>?<br \/>\na. 12th Amendment<br \/>\nb. 14th Amendment<br \/>\nc. 16th Amendment<br \/>\nd. 18th Amendment<\/p>\n<p>Answer: B. The Fourteenth Amendment discusses the right to equal protection under the law and the right to privacy. The Supreme Court decision, based on previous court cases, decided that a woman\u2019s right to abortion should be a private issue.<\/p>\n<p>How did you do on the <em>Roe v.
